Berlinsky Law Firm was founded in 2002 by Larry Berlinsky. The primary focus of our practice is the successful representation of individuals, families and small businesses located in Broward County, Palm Beach County, Miami-Dade County and throughout the State of Florida. Our practice areas include: Family Law: Divorce: We frequently represent clients in divorce litigation in circuit courts throughout the state, including complex international divorce cases. There are numerous factors which must be considered when going through a divorce, including child custody, child support, domestic violence, equitable distribution of assets, spousal maintenance and property division. High net worth individuals increase the complexity of a divorce case, requiring a skillful attorney who can understand and deal with complex financial issues and protect your rights and your future. Domestic Violence: In most cases, domestic violence proceedings in Texas are civil in nature. However, there are also criminal aspects to domestic violence. Most commonly associated with incidents where an offender causes physical violence, domestic violence also includes offensive contact and threats of violence. Both parties can seek a protective order against the other; however, it is strongly advised that you retain an attorney to represent you in the process. Our skilled team can assist clients with obtaining protective orders and to fight baseless or exaggerated claims for protective orders against them. Protection is often only temporary, but it can help protect you from a potentially violent party.
Child Custody: Child custody and visitation disputes must be resolved before a divorce can be finalized in Texas. Under Texas law, custody is referred to as conservatorship. There are numerous factors which the court will consider in determining what conservatorship arrangement is in the best interest of your children. Most importantly, judges do not award custody to a parent simply because he or she is the child’s primary caregiver. There are a number of rights and duties associated with conservatorship, and our skilled team is familiar with how a Texas family court judge may apply the law.
Child Support: Child support agreements can be confusing and often misunderstood by payors. Texas law does not allow for deviation from child support calculation formulas absent special circumstances. When entering into a child support agreement, it is critical that you are receiving adequate amount of child support and are able to enforce such terms. We carefully review child support agreements with both the noncustodial parent and the custodial parent.
Meet Our Experienced Attorneys
The key attorneys at Berlinsky Law Firm are Betty Berlinsky, J.D., the founder and principal of the firm and Robert J. Berlinsky, PhD, a member of the firm. Betty holds multiple advanced degrees in education from Columbia University and at the City University of New York presently teaches Learning Disabilities in the M.A. program at Teachers College, Columbia University. She teaches individuals with disabilities and their parents how to advocate for services to which they are entitled under the United States I.D.E.A. (Individuals with Disabilities Education Act). She is not an "advocate," but often collaborates with Special Education lawyers on creating language that persuades school districts to offer needed services to individuals with disabilities. Betty is an author of journal articles and book chapters published by notable publishers such as Longman Publishing Company and Guilford Press and was a co-author of a book titled College Students with Learning Disabilities: 50+ Tips for Faculty, which was published in November 2009 by the Council on Exceptional Children and was developed through years of working with college students with learning disabilities and faculty. She has worked in Special Education since 1973, and has also worked as an adjunct professor in graduate education programs at Columbia University, Hunter College and Marymount Manhattan College. She has been and remains an active member of New York State and New Jersey Bar Associations, and also taught Special Education and Summer Law School "intersessions" at New York Law School during her Legal Skills and Values in the New York practice setting course Barbara E. Presti. Betty also serves on the Ethics Board of Lighthouse International of New York City that provides programs and services for people dealing with vision loss.
Robert J. Berlinsky teaches and writes in the fields of healthcare law, health literacy for diverse populations and civil rights. He teaches Latinos in the U.S. Health Care System at New York Medical College and works as a consultant with The Center for Health Literacy, HealthCare Chaplaincy and other groups. He has published law review articles on the constitutional right to health care, disability rights, and cancer regulation. He also teaches about the legal issues that bioethicists face in teaching health law. He also provides faculty development and has created educational programs for interdisciplinary training at New York Medical College that include medical students, public health students, and chaplain interns, residents and faculty. Dr. Berlinsky is also a member of the faculty of the Simmons College Graduate School of Social Work. A lawyer and an ethicist, he also serves on the New York State board of the American Association of Bioethics and Humanities. His research interests include patient compliance, the use of advance directives and communications with religious organizations, as well as the history and philosophy of health law. He has served as an attorney-member on the Medical Malpractice Insurance Planning and Oversight Board in New Jersey, where he assisted in the drafting the patient’s bill of rights in New Jersey. Prior to his present work he served as an Associated Press staff writer in Madison Wisconsin. He has also worked as a senior writer at The Star Ledger in Newark New Jersey.
